Firearms

Certain individuals cannot legally receive or passes a firearm. Individuals who fall within one of the following criteria shall not purchase a firearm from rustyoakarmory.com:

• Is less than 21 years old;
• Has been convicted in any court of a crime punishable by imprisonment for a term exceeding 1 year;  
• Is a fugitive from justice;
• Is an unlawful user of or addicted to any controlled substance;
• Has been adjudicated as a mental defective or has been committed to a mental institution;
• Is an alien illegally or unlawfully in the United States or an alien admitted to the United States under a nonimmigrant visa;
• Has been discharged from the Armed Forces under dishonorable conditions;
• Was a citizen of the United States; yet, has renounced his or her citizenship
• Is subject to a court order that restrains the person from harassing, stalking, or threatening an intimate partner or child of such intimate partner; or 
• Has been convicted of a misdemeanor crime of domestic violence
• Cannot lawfully receive, possess, ship, or transport a firearm.

When purchasing a firearm, customer must provide us with a transfer dealer’s FFL for us to transfer the firearm to the transfer dealer. Then, the FFL transfer dealer will transfer the firearm to you. A copy of the transfer dealer’s FFL should be uploaded to our website when you place the order for faster service. Alternatively, you can email the transfer dealer’s FFL to [email protected] within 10 working days (Saturdays and Sundays do not count as working days). Orders that do not provide appropriate FFL information within 10 working days will be cancelled automatically.  

Please do your diligence and make sure that you are following local, state and federal laws when purchasing a firearm, and make sure that you DO NOT have any concerns regarding passing the background check. If you fail the background check and your FFL transfer dealer is able to ship the item back to us, we will charge a 25% restocking fee and refund the rest.

Given the restrictions and complications of the local and state laws, we do not ship firearms to California, New Jersey, New York, or Washington DC. We will cancel your orders automatically if your shipping address is within one of these states/areas. Thank you for your understanding. Right to Defend and Filter Reviews 

Only customers who have brought the items from rustyoakarmory.com can provide reviews. We have the right to inactivate a review that contain profanity, contains misinformation, or contains blatantly false details. When we receive such a review, we will reach out to the customer to rectify the issue. If the customer does not provide sufficient evidence of the discrepancy, we will then remove the review. 

Limitation of Liability

In no event shall Rusty Oak Armory, Rusty Oak Design and Fabrication, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
